AT5 What is the difference between assured and short assured?
ByI have read this -
http://scotland.shelter.org.uk/getadvice/jargonbuster/jargonbuster_terms/a/at5
But am still not clear what the difference between assured and short assured is. What extra rights does it give the landlord/tennants?
The flat I’m going to rent will be short assured.

Just follow the links in the Shelter website or give shelter a phone, they are really good at what they do, and can give you all the ins and outs of renting privately.

The agreements now are AST Assured Shorthold Tenancy. Assured tenancys are those that could be handed down from parents to child, there are still some of these older tenancies, but all tenancy’s now in UK are AST.

The position is not standard throughout the UK. Tenancies in Scotland are similar to those in England/Wales, but there are differences, so be careful about the advice you receive. The Shelter website can certainly be relied upon.
Both forms of tenancy are those where a weekly rent is payable, but they are set up differently. An assured tenancy rolls over from week to week until it is brought to an end by Notice. A short assured tenancy expires at the end of 6 months: it still requires notices to be given, but is one where a landlord can obtain possession a lot easier.
This does not mean that you have to move out after 6 months. Things could be allowed to roll onward, or the landlord could offer a new tenancy (which could include things such as an increased rent), at his/her discretion.
Effectively, the main difference between the two is the easier rights of possession with the short assured. And in case you were wondering, AT5 is one of the forms that needs to be used to properly handle a short assured tenancy.
